Robert E. Bell

B.J.'s primary area of practice is litigation, specializing in medical malpractice, health care, complex commercial disputes, business and energy disputes, premises liability and appellate.

B.J. began his legal career in 2002 practicing for seven years alongside John Serpe, Randy Jones and Nicole Andrews. In 2009 B.J. left Greenberg Traurig to co-found Serpe, Jones, Andrews, Callender & Bell, PLLC. B.J. litigates cases in state and federal courts across Texas and has handled appeals before several courts of appeals in Texas, including the Texas Supreme Court. B.J. and his wife Ashley, have two children, Savannah and Jackson.

Relevant Experience

  • Prosecuted and defended a natural gas midstream pipeline company in state district court and before the American Arbitration Association involving a contract dispute with a power plant owned by Direct Energy in South Texas. Successfully obtained a temporary injunction which enjoined the power plant from attempting a wrongful foreclosure sale. Successfully defended the injunction before the Thirteenth Court of Appeals, including oral argument before the court.
  • Defended a medical products company in a breach of contract lawsuit involving the purchase of radiation therapy machines. Obtained a favorable settlement.
  • Prosecuted a breach of contract lawsuit on behalf of a high level executive recruiting firm against a global expert services firm for unpaid placement fees for high level executives. Obtained a favorable settlement.
  • Defended a hospital in a medical negligence case in federal district court where the Plaintiff alleged infection from a neurosurgical procedure. The hospitals three co-defendants paid settlements totaling millions of dollars. Obtained summary judgment and complete dismissal for the hospital.
  • Defended several online travel companies in lawsuit brought by City of Houston and Harris County Sports Authority regarding hotel occupancy taxes. Successfully obtained summary judgment for the online travel companies, which was affirmed on appeal.
  • Defended a hospital, hospital’s CEO and healthcare entity in a lawsuit brought by a cardiovascular surgeon alleging breach of contract, fraud, business disparagement and other claims.
  • Defended physician against a complaint before the Texas Medical Board. Obtained complete dismissal for physician.
  • Defended health care providers in hundreds of health care liability claims involving allegations of: birth injury, stroke, cancer, Lasik surgery, nerve injury, infection, decubitis ulcers, compartment syndrome, medication errors, failure to monitor, failure to diagnose, delay in treatment, wrongful death, chain of command, negligent credentialing, negligent hiring, supervision and training, misdiagnosis and numerous others.
  • Successfully defended general surgeon in a lawsuit where the plaintiff alleged injury to her spinal accessory nerve as a result of a lymph node biopsy.
  • Successfully defended radiologist in a lawsuit alleging a failure to diagnose a stroke. Obtained a dismissal on behalf of the radiologist.
  • Successfully defended ophthalmologist in a lawsuit alleging complications as a result of a Lasik surgery procedure.
  • Defended a hospital where plaintiffs alleged a failure to diagnose renal cell carcinoma.
  • Defended a hospital where plaintiffs alleged birth injury as a result of improper administration of medication.
  • Defended a company where plaintiff claimed to have sustained an injury from an alleged malfunctioning elevator. Obtained a dismissal.
  • Defended company where plaintiff claimed to have sustained an injury from malfunctioning automatic sliding doors. Obtained a dismissal.
